Changes to the Service
We continually improve and modify the Service. Features may be added, changed, or removed without prior notice. We do not guarantee backward compatibility of APIs or features.
Ownership and Use of Content
All rights in the Service, including data, charts, and content, belong to Ai Trading, our affiliates, or our data providers.
Licensed use is display-only: you may view content for personal or internal business purposes.
Prohibited non-display uses include:
- Feeding data into automated or algorithmic trading systems.
- Using data for price referencing, order verification, or risk management without human display.
- Building products or services that rely on our data.
- Any machine-driven process without human interaction.
You may not sublicense, sell, distribute, decompile, reverse-engineer, or create derivative works from our software without written consent. Commercial use requires a separate agreement.
Attribution for Charts and Content
You may use chart snapshots in analysis, articles, books, blogs, or videos, provided you give clear, visible attribution to Ai Trading. For videos, verbal or written credit such as “Charts by Ai Trading” is required. Failure to provide attribution may result in account suspension or legal action.
Third-Party Links and Advertisers
The Service may contain links to third-party websites. We are not responsible for their content or your dealings with advertisers.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
We disclaim all warranties, express or implied, including accuracy, reliability, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, nor that the Service is free of viruses or harmful components.
Investment Disclaimer
We are not financial advisors. Trading involves significant risk. You are solely responsible for investment decisions and should consult a qualified professional. Ai Trading is not liable for losses arising from use of our Service.
Hypothetical Performance Disclaimer
Simulated or hypothetical trading results are illustrative only and do not predict actual outcomes. Past performance is not indicative of future results.
User Registration
To access certain features, you must register and:
- Provide accurate and complete information.
- Keep your details updated.
- Be of legal age to form a binding contract.
False information may result in suspension or termination. You are responsible for any content you post.
Non-Professional Subscriber Status
If you subscribe as a “Non-Professional,” you confirm use is solely personal. If you meet criteria for “Professional” status, you must pay the applicable fees retroactively.
Derived Data
Displayed price data is generated through proprietary processes. Raw market data is inaccessible and may not be reverse-engineered.
Account Security
You are responsible for safeguarding your credentials. Notify us immediately of unauthorized use. You remain liable for all activity under your account.
Feedback and Contributions
By submitting ideas or suggestions, you grant Ai Trading a perpetual, royalty-free license to use them without obligation or compensation.
Indemnification
You agree to indemnify and hold Ai Trading harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.
Termination
You may delete your account at any time. We may retain certain data for legitimate business purposes as outlined in our Privacy Policy.
We may suspend or terminate accounts without notice for violations, fraudulent activity, or legal requests. Published content may remain to preserve community integrity.
Emails
By registering, you consent to receive service-related and marketing emails. You may unsubscribe from marketing emails at any time.
House Rules
You agree to comply with our House Rules. Violations may result in warnings, suspension, or bans.
Third-Party Software
Third-party software included in the Service is subject to its own license terms.
Scripts
If you publish scripts, you must have the rights to do so. By publishing, you grant Ai Trading a license to display and distribute them. Absent a specified license, scripts default to the Mozilla Public License 2.0.
Publications
Content published by users or staff reflects personal opinions and does not constitute financial advice. Ai Trading is not liable for losses based on such content.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI TRADING AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
Liability for direct damages is limited to the greater of (a) $100 or (b) the fees paid by you in the 12 months preceding the claim. This limitation does not apply to gross negligence, willful misconduct, or fraud.
Arbitration Agreement
Applicability
All disputes shall be resolved through binding arbitration, except for small claims or intellectual property matters.
Waiver of Jury Trial and Class Actions
YOU AND AI TRADING WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS. Claims must be brought individually.
Arbitration Process
Arbitration will be administered by National Arbitration & Mediation (“NAM”) under its rules. To initiate, send a Demand for Arbitration to legal@ai-trading.biz. Similar claims may be grouped into batch arbitration for efficiency.
Costs
Each party will bear its own attorneys’ fees. Arbitration costs will be allocated under NAM rules unless otherwise required by law.
Opt-Out
You may opt out within 30 days of accepting these Terms by emailing legal@ai-trading.biz with your name, address, and a clear statement of opt-out.
Governing Law
The Federal Arbitration Act governs this agreement. All other matters are governed by Florida law. Non-arbitrable disputes shall be resolved exclusively in Florida courts.
